Second Wind Consultants issued an August 11, 2026 announcement about its Credit Rehabilitation Restructuring engagements through the firm and its Rise Alliance division. The statement was distributed by Business Wire and is available through a syndicated MarketMinute copy.
It is company-reported promotional material. Republishing the same release on multiple sites does not create independent confirmation of its engagement totals, obligations addressed, outcomes or growth calculation.
Read the scope before repeating the statistic
In that release, Second Wind states that over a twelve-month period more than 2,000 businesses entered CRR engagements through the firm and Rise Alliance, that those engagements addressed more than $300 million in merchant cash advance obligations, and that this marked a 30% increase over the prior year.
Those figures describe the firm's own reported engagements. They cannot, by themselves, establish a national increase in MCA restructuring cases, the share of distressed merchants receiving relief, or whether businesses are choosing workouts instead of bankruptcy.
Before treating any growth percentage as an industry statistic, obtain the base period, the measure that grew, the case-count methodology and evidence that repeated clients or obligations were not counted twice. This article attributes those numbers to Second Wind's press release and does not present them as independently audited industry data.
Federal 1071 reporting is a separate issue
The CFPB's May 1, 2026 final rule excludes MCA transactions from Section 1071 small-business lending data reporting under Regulation B subpart B. That is a covered-transaction exclusion for a data-collection rule, not proof that MCA distress is rising, and not a blanket statement that the CFPB has ended all MCA-related oversight. A company that also originates other covered credit products must still assess reporting coverage. The rule's initial compliance date is January 1, 2028.
Correcting the Illinois claim
The reviewed Illinois SB260 record describes an introduced Small Business Financing Transparency Act, not an enacted law that fully took effect January 1, 2026. A proposed earliest start date in bill text is not evidence of passage or an effective regulatory mandate.
For merchants considering a restructuring service, ask what work will be performed, what it costs, which creditors are participating and what results are actually promised in writing. Consult independent counsel about the specific agreements and risks.
